بَابُ مَا جَاءَ فِي طَلَاقِ السَّكْرَانِ وَمَنْ لَمْ يَرَهُ وَمَنْ أَجَازَهُChapter: What is reported regarding the divorce of the intoxicated, the absent, and those who permit it
Hadith 2294

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا إِسْمَاعِيلُ بْنُ سَالِمٍ، قَالَ: سَمِعْتُ الْحَكَمَ بْنَ عُتَيْبَةَ قَالَ: «مَنْ طَلَّقَ فِي سُكْرٍ مِنَ اللَّهِ عَزَّ وَجَلَّ فَلَيْسَ طَلَاقُهُ بِشَيْءٍ، وَمَنْ طَلَّقَ فِي سُكْرٍ مِنَ الشَّيْطَانِ فَطَلَاقُهُ لَهُ لَازِمٌ»
Hazrat Hakam bin Utaybah (may Allah have mercy on him) said: The divorce of one who is intoxicated out of fear of Allah is invalid, and the divorce of one who is intoxicated by Satan is binding.
