بَابُ مَا جَاءَ فِي طَلَاقِ السَّكْرَانِ وَمَنْ لَمْ يَرَهُ وَمَنْ أَجَازَهُChapter: What is reported regarding the divorce of the intoxicated, the absent, and those who permit it
Hadith 2287

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يَحْيَى بْنُ سَعِيدٍ، عَنْ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ «أَنَّهُ أُتِيَ بِرَجُلٍ طَلَّقَ امْرَأَتَهُ وَهُوَ سَكْرَانُ، فَاسْتَحْلَفَهُ بِاللَّهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ أَنَّهُ طَلَّقَ وَمَا يَعْقِلُ، فَحَلَفَ، فَرَدَّ عَلَيْهِ امْرَأَتَهُ وَضَرَبَهُ الْحَدَّ» .
A man who had divorced his wife while intoxicated came to Sayyiduna Umar bin Abdul Aziz (may Allah have mercy on him). He made him swear an oath that if he had given the divorce while unconscious, then he returned his wife to him and imposed the prescribed punishment.
