بَابُ مَا جَاءَ فِي طَلَاقِ السَّكْرَانِ وَمَنْ لَمْ يَرَهُ وَمَنْ أَجَازَهُChapter: What is reported regarding the divorce of the intoxicated, the absent, and those who permit it
Hadith 2283

حَدَّثَنَا سَعِيدٌ قَالَ: نا عَبْدُ اللَّهِ بْنُ وَهْبٍ، قَالَ: أَخْبَرَنِي مَخْرَمَةُ بْنُ بُكَيْرٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ مِقْسَمٍ، قَالَ: سَمِعْتُ سُلَيْمَانَ بْنَ يَسَارٍ، يَقُولُ: «إِنَّ رَجُلًا مِنْ آلِ الْبَخْتَرِيِّ طَلَّقَ امْرَأَتَهُ وَهُوَ سَكْرَانُ فَضَرَبَهُ عُمَرُ الْحَدَّ وَأَجَازَ عَلَيْهِ طَلَاقَهُ»
Sulaiman bin Yasar (may Allah have mercy on him) said: A man from the family of Bakhtari divorced his wife while intoxicated. Sayyiduna Umar (may Allah be pleased with him) imposed the prescribed punishment on him and enforced the divorce.
