Hadith 2216

حَدَّثَنَا سَعِيدٌ، نا عَتَّابُ بْنُ بَشِيرٍ، أنا خُصَيْفٌ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، أَنَّهُ حَلَفَ فِي امْرَأَةٍ إِنْ تَزَوَّجَهَا فَهِيَ طَالِقٌ، فَتَزَوَّجَهَا، فَأُخْبِرَ بِذَلِكَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ وَهُوَ أَمِيرٌ عَلَى الْمَدِينَةِ، فَأَرْسَلَ إِلَيْهِ: «بَلَغَنِي أَنَّكَ حَلَفْتَ فِي كَذَا»، قَالَ: نَعَمْ، قَالَ: أَفَلَا تُخَلِّي سَبِيلَهَا؟ قَالَ: لَا. فَتَرَكَهُ عُمَرُ، وَلَمْ يُفَرِّقْ بَيْنَهُمَا "
Sulaiman bin Yasar (may Allah have mercy on him) swore an oath regarding a woman that if he married her, she would be divorced. And when he married her, Umar bin Abdul Aziz (may Allah have mercy on him) investigated and upheld the marriage.
