بَابُ الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ فَيَدْخُلُ عَلَيْهَا وَمَعَهَا نِسَاءٌ فَوَقَعَ عَلَى امْرَأَةٍ مِنْهُنَّChapter: A man marries a woman, enters upon her, and there are other women with her, and he has intercourse with one of them

حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ أَنَّهُ سُئِلَ عَنْ رَجُلٍ خَطَبَ إِلَى قَوْمٍ، فَزَوَّجُوهُ عَلَى إِنْ كَانَ لَهُ امْرَأَةٌ فَصَدَاقُ صَاحِبَتِهِمْ أَلْفَانِ، فَإِنْ لَمْ يَكُنْ لَهُ امْرَأَةٌ فَصَدَاقُهَا أَلْفٌ، فَزَوَّجُوهُ عَلَى ذَلِكَ، فَوَجَدُوا لَهُ امْرَأَةً، فَقَالَ الشَّعْبِيُّ: «لَهَا أَخَسُّ الصَّدَاقَيْنِ»
It is narrated from Hazrat Sha'bi (may Allah have mercy on him) that a man contracted marriage on the condition that if he had a wife, the dowry would be two thousand; if not, then one thousand. Later it was found out that he had a wife. Hazrat Sha'bi (may Allah have mercy on him) said: "The woman will receive the lesser dowry."
