بَابُ مَا جَاءَ فِي الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ فَتَمُوتُ قَبْلَ أَنْ يَدْخُلَ بِهَا أَوْ يُطَلِّقَهَا، هَلْ يَصْلُحُ لَهُ أَنْ يَتَزَوَّجَ أُمَّهَاChapter: What is reported regarding a man marrying a woman, then she dies before consummation or he divorces her—can he marry her mother?
Hadith 2118

حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا يُونُسُ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ: «إِذَا تَزَوَّجَ أُمَّ امْرَأَتِهِ وَقَدْ دَخَلَ بِامْرَأَتِهِ فَارَقَهُمَا جَمِيعًا، وَإِنْ كَانَتِ الْأُخْتُ أَقَامَ عَلَى امْرَأَتِهِ وَلَمْ يَقْرَبْهَا حَتَّى يَسْتَبْرِئَ رَحِمَ الْأُخْرَى، فَإِذَا اسْتَبْرَأَ رَحِمَهَا رَجَعَ إِلَى امْرَأَتِهِ»
Sayyiduna Hasan al-Basri (may Allah have mercy on him) said: "If a man marries his wife's mother while he has already consummated the marriage with his wife, then he must leave both of them. And if he marries his wife's sister, then he should remain with his wife, but he must not have intercourse with her until the other woman's womb becomes pure, then he may return to his wife."
