Hadith 2105

حَدَّثَنَا سَعِيدٌ، نا عَطَّافُ بْنُ خَالِدٍ، عَنْ نَافِعٍ، قَالَ: زَوَّجَ ابْنُ عُمَرَ ابْنَهُ ابْنَةَ أَخِيهِ، فَمَاتَتِ الْجَارِيَةُ قَبْلَ أَنْ يَفْرِضَ لَهَا صَدَاقًا، فَسَأَلَتْ أُمُّهَا صَدَاقَهَا، فَقَالَ ابْنُ عُمَرَ: " لَيْسَ لَهَا صَدَاقٌ. فَاخْتَصَمُوا إِلَى زَيْدِ بْنِ ثَابِتٍ، فَقَالَ: «لَيْسَ لَهَا صَدَاقٌ، وَلَهَا الْمِيرَاثُ»
Masruq (may Allah have mercy on him) said: "There is never inheritance except that there is a dowry before it."
Brief Explanation
‘Ataf bin Khalid al-Makhzumi is truthful (saduq). Some have said: “There is some weakness (fi-hi lin) in him,” but Imam Ahmad said: “There is no harm in him (la ba’sa bihi).” The chain is hasan (good), especially because it is narrated from Nafi‘, and there is no major criticism (jarh) upon ‘Ataf. This is a practical incident and a legal case, which has been narrated through a trustworthy Tabi‘i.
