بَابُ الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ فَيَمُوتُ وَلَمْ يَفْرِضْ لَهَا صَدَاقًاChapter: A man marries a woman and dies without specifying a dowry for her
Hadith 2104

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، أنا دَاوُدُ، عَنِ الشَّعْبِيِّ، قَالَ: ذُكِرَ قَوْلُ أَهْلِ الْمَدِينَةِ هَذَا لِمَسْرُوقٍ، فَقَالَ مَسْرُوقٌ: «مَا كَانَ مِيرَاثٌ قَطُّ إِلَّا وَبَيْنَ يَدَيْهِ صَدَاقٌ»
Abdullah bin Umar and Zaid bin Thabit (may Allah be pleased with them) said: "Such a woman will receive inheritance, but not the dowry (mahr)." Masruq (may Allah have mercy on him) said: "Inheritance was never given except after the dowry (mahr)."
