بَابُ الرَّجُلِ يَتَزَوَّجُ الْمَرْأَةَ فَيَمُوتُ وَلَمْ يَفْرِضْ لَهَا صَدَاقًاChapter: A man marries a woman and dies without specifying a dowry for her
Hadith 2103

حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ دَاوُدَ، عَنْ عَامِرٍ الشَّعْبِيِّ، أَنَّ ابْنَ عُمَرَ، وَزَيْدَ بْنَ ثَابِتٍ قَالَا فِي رَجُلٍ تَزَوَّجَ امْرَأَةً وَلَمْ يَفْرِضْ لَهَا صَدَاقًا فَمَاتَ، قَالَا: «لَهَا الْمِيرَاثُ، وَلَا صَدَاقَ لَهَا» قَالَ مَسْرُوقٌ: «مَا كَانَ مِيرَاثٌ قَطُّ إِلَّا وَكَانَ قَبْلَهُ صَدَاقٌ»
Ibn Umar and Zaid bin Thabit (may Allah be pleased with them) said: "Such a woman will receive inheritance, but not the dowry (mahr)." Masruq (may Allah have mercy on him) said: "Inheritance was never given except after the dowry (mahr)."
