بَابُ الْعَبْدِ يَتَزَوَّجُ بِغَيْرِ إِذْنِ سَيِّدِهِChapter: A slave marries without his master's permission

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، أنا خَالِدٌ، عَنِ ابْنِ سِيرِينَ، أَنَّ غُلَامًا تَزَوَّجَ بِغَيْرِ إِذْنِ مَوْلَاهُ فَرُفِعَ ذَلِكَ إِلَى الْأَشْعَرِيِّ، فَكَتَبَ إِلَى عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ وَكَانَ أَصْدَقَهَا خَمْسَ ذَوْدٍ , فَكَتَبَ عُمَرُ إِلَيْهِ: «أَنْ أَعْطِهَا ثَلَاثَةً وَخُذْ مِنْهَا اثْنَيْنِ أَوْ أَعْطِهَا اثْنَيْنِ وَخُذْ مِنْهَا ثَلَاثًا»
It is narrated from Ibn Sirin, may Allah have mercy on him: A slave married without the permission of his master, so the matter reached Sayyiduna Umar bin Khattab, may Allah be pleased with him, and the slave had set five she-camels as dowry. Sayyiduna Umar, may Allah be pleased with him, wrote: "Give three she-camels to the woman, and take back two, or give two she-camels and take back three."
