حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ يُونُسَ بْنِ عُبَيْدٍ، عَنِ الْوَلِيدِ بْنِ أَبِي هَاشِمٍ، أَنَّ امْرَأَةً تُوُفِّيَ عَنْهَا زَوْجُهَا، ثُمَّ تَزَوَّجَتْ، فَوَضَعَتْ عِنْدَ زَوْجِهَا لِأَرْبَعَةِ أَشْهُرٍ فَأَنْكَرَ ذَلِكَ الزَّوْجُ، فَرُفِعَ إِلَى عُمَرَ بْنِ الْخَطَّابِ، وَسَأَلَ الْمَرْأَةَ فَقَالَتْ: " وَاللَّهِ مَا كَانَ بَيْنَهُمَا رَجُلٌ، وَلَكِنَّ زَوْجِي كَانَ عَهْدُهُ بِي قَبْلَ وَفَاتِهِ بِخَمْسَةَ عَشَرَ يَوْمًا، فَهَلَكَ وَكُنْتُ أَرَى الدَّمَ، فَسَأَلَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ نِسَاءً مِنْ نِسَاءِ الْجَاهِلِيَّةِ، فَقُلْنَ: إِنَّ هَذَا يَكُونُ، فَفَرَّقَ بَيْنَهُمَا وَجَعَلَ الْوَلَدَ لِلْأَوَّلِ "
It is narrated from Hazrat Waleed bin Abi Hashim, may Allah have mercy on him, that a woman married after her husband passed away and gave birth to a child four months later. The case was brought to Sayyiduna Umar bin Khattab, may Allah be pleased with him. He inquired from the women, and the women informed him that this was possible. Accordingly, he attached the woman to her first husband and attributed the child to him.
