بَابُ الْمَرْأَةِ تُزَوَّجُ فِي عِدِّتِهَاChapter: A woman marrying during her waiting period ('iddah)

حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ إِسْمَاعِيلَ بْنِ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ، عَنْ مَسْرُوقٍ فِي الَّتِي تَزَوَّجَتْ فِي عِدَّتِهَا قَالَ: فَرَّقَ عُمَرُ بَيْنَهُمَا، وَقَالَ: «كَانَ النِّكَاحُ حَرَامًا فَجَعَلَ الصَّدَاقَ حَرَامًا، فَجَعَلَ الصَّدَاقَ فِي بَيْتِ الْمَالِ»
It is narrated from Hazrat Masruq (may Allah have mercy on him) that a woman who had married during her waiting period (‘iddah), Sayyiduna Umar bin Khattab (may Allah be pleased with him) separated them and said: “This marriage was unlawful, therefore the dowry (mahr) is also unlawful.” And he deposited the dowry into the public treasury (Bayt al-Mal).
