حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عُبَيْدٍ، عَنْ مَكْحُولٍ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، رَضِيَ اللَّهُ عَنْهُ قَالَ فِي رَجُلٍ شَرَطَ لِامْرَأَةٍ دَارَهَا، فَقَالَ: «لَا يُخْرِجُهَا إِلَّا أَنْ تَشَاءَ لِأَنَّ مَقَاطِعَ الْحُقُوقِ الشُّرُوطُ» وَكَانَ مَكْحُولٌ يَرَاهُ
Sayyiduna Umar bin Khattab (may Allah be pleased with him) said: "If a person has stipulated the condition of a house for a woman in marriage, then he cannot turn her out without her consent, because the decision of rights is based on conditions." Hazrat Mak'hool (may Allah have mercy on him) also held the same view.
