بَابُ تَزْوِيجِ الْجَارِيَةِ الصَّغِيرَةِChapter: Marrying a young girl

حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنْ أَيُّوبَ بْنِ مُوسَى، عَنِ ابْنِ قُسَيْطٍ، قَالَ بُشِّرَ رَجُلٌ بِجَارِيَةٍ فَقَالَ رَجُلٌ: هَبْهَا لِي، فَقَالَ: هِيَ لَكَ فَسُئِلَ سَعِيدُ بْنُ الْمُسَيِّبِ عَنْ ذَلِكَ، فَقَالَ «لَا تَحِلُّ الْهِبَةُ لِأَحَدٍ بَعْدَ رَسُولِ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، وَلَوْ أَصْدَقَهَا سَوْطًا حَلَّتْ لَهُ»
It is narrated from Sa'id bin al-Musayyib (may Allah have mercy on him): "No one is permitted to marry without a dowry after the Messenger of Allah (peace and blessings be upon him). If someone gives even a whip as a dowry, the marriage will be valid."
