بَابُ تَزْوِيجِ الْجَارِيَةِ الصَّغِيرَةِChapter: Marrying a young girl

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: نا سَيَّارٌ، عَنِ الشَّعْبِيِّ، أَنَّ رَجُلًا كَانَ فِي سَفَرٍ فَقَالَ لِأَصْحَابِهِ: أَيُّكُمْ يَذْبَحُ لَنَا شَاةً وَأُزَوِّجَهُ أَوَّلَ بِنْتٍ تُولَدُ لِي، فَفَعَلَ ذَلِكَ رَجُلٌ مِنَ الْقَوْمِ، فَذَبَحَ لَهُمْ شَاةً، فَوُلِدَ لِلرَّجُلِ ابْنَةٌ، فَأَتَاهُ فَقَالَ: امْرَأَتِي فَأَتَوَا ابْنَ مَسْعُودٍ رَحِمَهُ اللَّهُ، فَقَالَ ابْنُ مَسْعُودٍ: «وَجَبَ النِّكَاحُ بِالشَّاةِ، وَلَهَا صَدَاقُ مِثْلِهَا، لَا وَكْسَ وَلَا شَطَطَ»
It is narrated from Sha'bi (may Allah have mercy on him) that a man said during a journey: "Who will slaughter a goat for us, and I will marry my first-born daughter to him?" A man slaughtered the goat. Then, when the girl was born, he made a claim. The matter was brought before Ibn Mas'ud (may Allah have mercy on him). He said: "The marriage has become binding, and the woman will be given a mahr equivalent to that of her peers, neither less nor more."
