بَابُ مَا جَاءَ فِي الصَّدَاقِChapter: What is reported regarding the dowry (mahr)

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: نا مُجَالِدٌ، عَنِ الشَّعْبِيِّ قَالَ: خَطَبَ عُمَرُ بْنُ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ النَّاسَ فَحَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ، وَقَالَ: أَلَا لَا تُغَالُوا فِي صُدُقِ النِّسَاءِ فَإِنَّهُ لَا يَبْلُغُنِي عَنْ أَحَدٍ سَاقَ أَكْثَرَ مِنْ شَيْءٍ سَاقَهُ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ أَوْ سِيقَ إِلَيْهِ إِلَّا جَعَلْتُ فَضْلَ ذَلِكَ فِي بَيْتِ الْمَالِ، ثُمَّ نَزَلَ فَعَرَضَتْ لَهُ امْرَأَةٌ مِنْ قُرَيْشٍ فَقَالَتْ: يَا أَمِيرَ الْمُؤْمِنِينَ كِتَابُ اللَّهِ عَزَّ وَجَلَّ أَحَقُّ أَنْ يُتَّبَعَ أَوْ قَوْلُكَ؟ قَالَ: بَلْ كِتَابُ اللَّهِ عَزَّ وَجَلَّ فَمَا ذَلِكَ؟ قَالَتْ: نَهَيْتَ النَّاسَ آنِفًا أَنْ يُغَالُوا فِي صُدُقِ النِّسَاءِ وَاللَّهُ عَزَّ وَجَلَّ يَقُولُ فِي كِتَابِهِ {وَآتَيْتُمْ إِحْدَاهُنَّ قِنْطَارًا فَلَا تَأْخُذُوا مِنْهُ شَيْئًا} [النساء: 20] فَقَالَ عُمَرُ: كُلُّ أَحَدٍ أَفْقَهُ مِنْ عُمَرَ مَرَّتَيْنِ أَوْ ثَلَاثًا ثُمَّ رَجَعَ إِلَى الْمِنْبَرِ فَقَالَ لِلنَّاسِ: «إِنِّي نَهَيْتُكُمْ أَنْ تُغَالُوا فِي صُدُقِ النِّسَاءِ أَلَا فَلْيَفْعَلْ رَجُلٌ فِي مَالِهِ مَا بَدَا لَهُ»
Sayyiduna Umar bin Khattab (may Allah be pleased with him) delivered a sermon and said: "Do not increase the dowries of women. If I come to know that anyone has given or taken a dowry more than what the Messenger of Allah (peace and blessings be upon him) gave or took, I will deposit the excess wealth into the public treasury (Bayt al-Mal)." Then a Qurayshi woman said: "O Commander of the Believers! Does the Book of Allah, the Mighty and Majestic, have more right or your statement?" Sayyiduna Umar (may Allah be pleased with him) said: "The Book of Allah, the Mighty and Majestic." She said: "You have forbidden people from increasing dowries, whereas Allah, the Mighty and Majestic, says: «وَآتَيْتُمْ إِحْدَاهُنَّ قِنْطَارًا فَلَا تَأْخُذُوا مِنْهُ شَيْئًا» [النساء: 20]." So Sayyiduna Umar (may Allah be pleased with him) said: "Everyone is more knowledgeable in jurisprudence than Umar." Then he returned to the pulpit and said: "I had forbidden you from increasing the dowries of women, so now everyone may do as he wishes with his wealth."
