بَابُ مَا جَاءَ فِي اسْتِئْمَارِ الْبِكْرِ وَالثَّيِّبِChapter: What is reported regarding seeking the consent of a virgin and a previously married woman
Hadith 1760

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ بْنُ عُبَيْدٍ، عَنْ حُمَيْدِ بْنِ هِلَالٍ، أَنَّ زِيَادًا، بَعَثَ أَبَا بُرْدَةَ بْنَ أَبِي مُوسَى عَلَى بَعْضِ الصَّدَقَاتِ، فَقَالَ لَهُ: " إِنِّي أُنْزِلُكَ نَفْسِي مِنْ هَذَا الْمَالِ بِمَنْزِلَةِ وَالِي الْيَتِيمِ، «وَمَنْ كَانَ غَنِيًّا فَلْيَسْتَعْفِفْ وَمَنْ كَانَ فَقِيرًا فَلْيَأْكُلْ بِالْمَعْرُوفِ» [النساء: 6]، وَلَا تَأْتِيَنَّ عَلَى شِغَارٍ إِلَّا رَدَدْتَهُ، وَلَا امْرَأَةٍ عَضَلَهَا وَلِيُّهَا فَتَبْرَحُ زَائِلَةَ الْعَطَنِ حَتَّى تُزَوِّجَهَا فِي الْأَكْفَاءِ مِنْ قَوْمِهَا " ¤ حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، قَالَ: جَاءَ رَجُلٌ إِلَى عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ: " يَا أَمِيرَ الْمُؤْمِنِينَ، مَا أَمْرِي وَأَمْرُ يَتِيمَتِي؟ قَالَ: عَنْ أَيِّ بَالِكُمَا تَسْأَلُ؟ ثُمَّ قَالَ لَهُ: أَمُتَزَوِّجُهَا أَنْتَ غَنِيَّةً جَمِيلَةً؟ قَالَ: نَعَمْ وَالْإِلَهِ. قَالَ: فَتَزَوَّجْهَا ذَمِيمَةً لَا مَالَ لَهَا، خِرْ لَهَا، فَإِنْ كَانَ غَيْرُكَ فَأَلْحِقْهَا بِالْخِيَارِ "
Ziyad sent Sayyiduna Abu Burdah bin Abi Musa (may Allah be pleased with him) over the charities and said: "I place you and myself in the position of a guardian of an orphan, and Allah Almighty has said: «وَمَنْ كَانَ غَنِيًّا فَلْيَسْتَعْفِفْ وَمَنْ كَانَ فَقِيرًا فَلْيَأْكُلْ بِالْمَعْرُوفِ» [النساء: 6]. If you come across any shighar (exchange marriage), then reject it, and do not leave any woman whom her guardian prevents (from marriage) until you marry her to someone equal from her people."
A man came to Sayyiduna Ali (may Allah be pleased with him) and said: "O Commander of the Faithful! What is the matter between me and my orphan girl?" He replied: "What are you asking about? Do you yourself wish to marry a wealthy and beautiful woman?" He said: "Yes, by Allah!" He replied: "Then marry someone who is ugly and poor, that will be better for her, and if it is someone else (who wishes to marry her), then give her the choice."
