بَابُ مَا جَاءَ فِي اسْتِئْمَارِ الْبِكْرِ وَالثَّيِّبِChapter: What is reported regarding seeking the consent of a virgin and a previously married woman
Hadith 1759

حَدَّثَنَا سَعِيدٌ قَالَ: نَا هُشَيْمٌ، قَالَ: أَنَا يُونُسُ بْنُ عُبَيْدٍ، عَنْ حُمَيْدِ بْنِ هِلَالٍ، أَنَّ زِيَادًا، بَعَثَ أَبَا بُرْدَةَ بْنَ أَبِي مُوسَى عَلَى بَعْضِ الصَّدَقَاتِ، فَقَالَ لَهُ: « إِنِّي أُنْزِلُكَ وَنَفْسِي مِنْ هَذَا الْمَالِ بِمَنْزِلَةِ وَالِي الْيَتِيمِ، مَنْ كَانَ غَنِيًّا فَلْيَسْتَعْفِفْ وَمَنْ كَانَ فَقِيرًا فَلْيَأْكُلْ بِالْمَعْرُوفِ، وَلَا تَأْتِيَنَّ عَلَى شِغَارٍ إِلَّا رَدَدْتَهُ، [6/188] وَلَا امْرَأَةٍ عَضَلَهَا وَلِيُّهَا فَتَبْرَحُ زَائِلَةَ الْعَطَنِ حَتَّى تُزَوِّجَهَا فِي الْكَفَاةِ مِنْ قَوْمِهَا » .
Ziyad sent Abu Burdah bin Abi Musa (may Allah be pleased with him) over some charities and said: "I place you and myself in the position of a guardian of an orphan regarding this wealth: whoever is rich should abstain, and whoever is poor may eat according to what is customary. If you come across any shighar (exchange marriage), then reject it, and do not approach any woman whom her guardian is withholding until you marry her to someone of her own people who is her equal."
