Hadith 1738

حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا أَشْعَثُ بْنُ سَوَّارٍ، عَنِ ابْنِ سِيرِينَ، عَنْ شُرَيْحٍ، أَنَّهُ كَانَ يَقُولُ فِي الْيَتِيمَةِ: «لَا تُنْكَحُ حَتَّى تُسْتَأْمَرَ، فَإِنْ سَكَتَتْ فَهُوَ رِضَاهَا، وَإِنْ كَرِهَتْ وَتَعَصَّتْ لَمْ تُنْكَحْ»
Hazrat Shurayh (may Allah have mercy on him) said: "The marriage of an orphan girl will take place when she accepts with silence or consent; if she refuses, then it will not take place."
