Hadith 1737

حَدَّثَنَا سَعِيدٌ، قَالَ: نا هُشَيْمٌ، أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ قَالَ: «لَا تُنْكَحُ الْيَتِيمَةُ حَتَّى تُسْتَأْمَرَ، فَإِنْ سَكَتَتْ أَوْ بَكَتْ فَهُوَ رِضَاهَا، وَإِنْ كَرِهَتْ لَمْ تُنْكَحْ»
Ibrahim al-Nakha'i (may Allah have mercy on him) said: "Permission should be sought from the orphan girl before marriage; if she cries or remains silent, then this is consent, but if she refuses, then the marriage should not take place."
