بَابُ مَنْ قَالَ: لَا نِكَاحَ إِلَّا بِوَلِيٍّChapter: Whoever said, "There is no marriage except with a guardian"
Hadith 1718

حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُحَمَّدُ بْنُ سَالِمٍ، عَنِ الشَّعْبِيِّ، قَالَ: «لَيْسَ إِلَى الْوَصِيِّ مِنَ النِّكَاحِ شَيْءٌ، إِنَّمَا ذَلِكَ إِلَى الْوَلِيِّ»
Al-Sha'bi (may Allah have mercy on him) said: "The executor (wasiyy) does not have the right to conduct marriage; the authority of marriage belongs to the guardian (wali)."
