بَابُ مَنْ قَالَ: لَا نِكَاحَ إِلَّا بِوَلِيٍّChapter: Whoever said, "There is no marriage except with a guardian"
Hadith 1716

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، أنا أَشْعَثُ بْنُ عَبْدِ الْمَلِكِ، عَنِ الْحَسَنِ، قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «إِذَا أَنْكَحَ الْوَلِيَّانِ فَهِيَ امْرَأَةُ الْأَوَّلِ، وَإِذَا بَاعَ الْمُجِيزَانِ فَالْبَيْعُ لِلْأَوَّلِ» .
The Messenger of Allah (peace and blessings be upon him) said: "If two guardians contract a marriage, then the first marriage will be valid; likewise, if there are two sellers, then the first sale will be valid."
