بَابُ مَنْ قَالَ: لَا نِكَاحَ إِلَّا بِوَلِيٍّChapter: Whoever said, "There is no marriage except with a guardian"
Hadith 1713

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، أنا زَكَرِيَّا، عَنِ الشَّعْبِيِّ، أَنَّهُ سُئِلَ عَنِ امْرَأَةٍ، تَزَوَّجَتْ وَأَبُوهَا غَائِبٌ، فَدَخَلَ بِهَا زَوْجُهَا، فَقَالَ الشَّعْبِيُّ: «أَمَّا إِذَا كَانَ دَخَلَ بِهَا زَوْجُهَا فَلْتَسْكُتْ»
Al-Sha'bi (may Allah have mercy on him) said: "If a woman has been married and her husband has already had intercourse with her, then silence should be observed."
