بَابُ مَنْ قَالَ: لَا نِكَاحَ إِلَّا بِوَلِيٍّChapter: Whoever said, "There is no marriage except with a guardian"
Hadith 1712

حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا إِسْمَاعِيلُ بْنُ سَالِمٍ، قَالَ الشَّعْبِيُّ، وَسُئِلَ عَنِ امْرَأَةٍ تَزَوَّجَتْ وَوَلِيُّهَا غَائِبٌ، فَقَالَ الشَّعْبِيُّ: «إِنْ كَانَتْ تَزَوَّجَتْ فِي غَيْرِ كَفَاءَةٍ وَصِحَّةٍ فَنِكَاحُهَا بَاطِلٌ، وَإِنْ كَانَتْ تَزَوَّجَتْ فِي كَفَاءَةٍ فَإِنَّ الْأَمْرَ إِلَى الْوَلِيِّ، إِنْ شَاءَ أَجَازَ، وَإِنْ شَاءَ رَدَّ»
Hazrat al-Sha'bi (may Allah have mercy on him) said: "If a woman contracts marriage in the absence of a guardian, then in the case of insufficiency, the marriage is invalid."
