بَابٌ فِي الْمُكَاتَبِ يَمُوتُ وَيَتْرُكُ وَرَثَةً وَعَلَيْهِ بَقِيَّةٌ مِنْ مُكَاتَبَتِهِChapter: The mukatab (contracted slave) dies leaving heirs and still owes part of his contract
Hadith 1655

سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ سَعِيدِ بْنِ يُوسُفَ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ، قَالَ: أَخْبَرَنِي عَبْدُ اللَّهِ بْنُ يَزِيدَ، أَنَّ سَعِيدَ بْنَ الْمُسَيِّبِ، وَأَبَا سَلَمَةَ بْنَ عَبْدِ الرَّحْمَنِ قَضَيَا فِي رَجُلٍ تُوُفِّيَ وَتَرَكَ مُكَاتَبًا لَهُ، وَلِلْمُتَوَفَّى بَنُونَ وَبَنَاتٌ، ثُمَّ إِنَّ الْمُكَاتَبَ مَاتَ وَتَرَكَ مَالًا أَفْضَلَ مِنْ مُكَاتَبَتِهِ، أَنَّ مَا بَقِيَ مِنَ الْمُكَاتَبَةِ لِلرِّجَالِ وَالنِّسَاءِ مِنْ وَرَثَةِ الْمَوْلَى، وَمَا كَانَ مِنْ مَالٍ بَعْدَ ذَلِكَ لِلرِّجَالِ دُونَ النِّسَاءِ
Hazrat Saeed bin Musayyib (may Allah have mercy on him) and Hazrat Abu Salamah (may Allah have mercy on him) gave the verdict that "the payment of the Mukatab will be divided among the men and women, and the remaining wealth will go to the men."
