Hadith 1625

سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ فِي الْمُعْتَقِ عَنْ دُبُرٍ: «إِنَّهُ لَا يُبَاعُ» . فَقِيلَ لَهُ: فَإِنِ احْتَاجَ صَاحِبُهُ وَلَمْ يَكُنْ لَهُ شَيْءٌ غَيْرُهُ؟ فَلَمْ يَزَالُوا بِهِ حَتَّى رَخَّصَ لَهُمْ، وَكَانَ قَوْلُهُ أَنْ لَا يُبَاعَ "
Hasan al-Basri (may Allah have mercy on him) said: "It is not permissible to sell a mudabbar slave. However, if the owner is in need and has no other wealth, then permission is given to sell him, but their original statement is that selling him is not correct."
