بَابُ الرَّجُلِ يُعْتِقُ عِنْدَ مَوْتِهِ وَلَيْسَ لَهُ مَالٌ غَيْرُهُChapter: A man frees a slave at his death and has no other wealth
Hadith 1592

سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، أَنَّهُ كَانَ يَقُولُ مِثْلَ قَوْلِ إِبْرَاهِيمَ وَالشَّعْبِيِّ إِذَا لَمْ يَكُنْ عَلَيْهِ دَيْنٌ، فَإِذَا كَانَ عَلَيْهِ دَيْنٌ أَكْثَرُ مِنْ قِيمَتِهِ فَهُوَ رَقِيقٌ يُبَاعُ، إِلَّا أَنْ يَكُونَ الدَّيْنُ أَقَلَّ مِنْ قِيمَتِهِ بِدِرْهَمٍ وَاحِدٍ فَمَا سِوَى ذَلِكَ، فَإِذَا كَانَ كَذَلِكَ وَقَعَتِ السِّعَايَةُ
Hasan al-Basri (may Allah have mercy on him) said: "If a slave has no debt, then one-third will be freed and two-thirds will work, and if the slave has such a debt that it is more than his value, then he will be sold."
