بَابُ الرَّجُلِ يُوصِي لِلرَّجُلِ فَيَمُوتُ الْمُوصَى لَهُChapter: A man bequeaths to another man, but the legatee dies
Hadith 1558

سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا أَبُو عَاصِمٍ الثَّقَفِيُّ، قَالَ: قَالَ لِي إِبْرَاهِيمُ النَّخَعِيُّ: مَا تَقُولُ فِي رَجُلٍ أَوْصَى بِنِصْفِ مَالِهِ، وَثُلُثِ مَالِهِ، وَرُبُعِ مَالِهِ؟ قُلْتُ: لَا يَجُوزُ، قَالَ: فَإِنَّهُمْ قَدْ أَجَازُوا، قُلْتُ: لَا أَدْرِي، قَالَ: أَمْسَكَ اثْنَتَيْ عَشْرَةَ فَأَخْرَجَ نِصْفَهَا سِتَّةً، وَثُلُثَهَا أَرْبَعَةً، وَرُبُعَهَا ثَلَاثَةً , فَأَقْسَمَ الْمَالَ عَلَى ثَلَاثَةَ عَشَرَ فَلِصَاحِبِ النِّصْفِ سِتَّةٌ، وَلِصَاحِبِ الثُّلُثِ أَرْبَعَةٌ، وَلِصَاحِبِ الرُّبُعِ ثَلَاثَةٌ "
Ibrahim Nakha'i (may Allah have mercy on him) said: "If a person makes a bequest of half, a third, and a quarter of his wealth, then twelve dirhams will be assumed; half of them is six dirhams, a third is four dirhams, and a quarter is three dirhams. Then the wealth will be divided into thirteen parts; the one with half will get six, the one with a third will get four, and the one with a quarter will get three shares."
