بَابٌ: هَلْ يُوصِي الرَّجُلُ مِنْ مَالِهِ بِأَكْثَرَ مِنَ الثُّلُثِChapter: Can a man bequeath more than a third of his wealth?
Hadith 1540

سَعِيدٌ قَالَ: نا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ، عَنْ يَعْقُوبَ بْنِ الْقَعْقَاعِ، عَنْ عَطَاءٍ، وَمُحَمَّدِ بْنِ صُهَيْبٍ، عَنْ عِكْرِمَةَ، فِي رَجُلٍ أَوْصَى بِسَهْمٍ مِنْ مَالِهِ , قَالَ: «لَا , لَيْسَ بِشَيْءٍ، لَمْ يُبَيِّنْ»، وَقَالَ الْحَسَنُ: «لَهُ السُّدُسُ عَلَى كُلِّ حَالٍ»
Ata and Ikrimah (may Allah have mercy on them) said: "Whoever makes a bequest of a share in his wealth, it is nothing, because he has not specified." And Hasan al-Basri (may Allah have mercy on him) said: "His right in every case is one-sixth."
