بَابٌ: هَلْ يُوصِي الرَّجُلُ مِنْ مَالِهِ بِأَكْثَرَ مِنَ الثُّلُثِChapter: Can a man bequeath more than a third of his wealth?
Hadith 1539

سَعِيدٌ قَالَ: نا أَبُو شِهَابٍ، عَنِ الْأَعْمَشِ، عَنْ مُسْلِمِ بْنِ صُبَيْحٍ، عَنْ مَسْرُوقٍ، فِي رَجُلٍ وَهَبَ لِأَوْلَادِهِ فَآثَرَ بَعْضَهُمْ عَلَى بَعْضٍ، فَقَالَ لَهُ: «إِنَّ اللَّهَ قَدْ قَسَمَ بَيْنَكُمْ فَأَحْسَنَ الْقِسْمَةَ، وَإِنَّهُ مَنْ يَرْغَبْ بِرَأْيِهِ عَنْ رَأْيِ اللَّهِ يَضِلَّ فَأَوْصِ لِذِي قَرَابَتِكَ مِمَّنْ لَا يَرِثُكَ، وَدَعِ الْمَالَ عَلَى قِسْمَةِ اللَّهِ»
Masruq (may Allah have mercy on him) said: "Whoever gives preference to one of his children over another, Allah has made the best division among you. Whoever puts his own opinion before Allah's opinion will go astray. Make bequests for your non-heir relatives and leave the wealth to Allah's division."
