بَابٌ: هَلْ يُوصِي الرَّجُلُ مِنْ مَالِهِ بِأَكْثَرَ مِنَ الثُّلُثِChapter: Can a man bequeath more than a third of his wealth?
Hadith 1538

سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ مُسْلِمِ بْنِ صُبَيْحٍ، عَنْ مَسْرُوقٍ، قَالَ: " حَضَرَ رَجُلًا يُوصِي , فَأَوْصَى بِأَشْيَاءَ لَا يَنْبَغِي، فَقَالَ لَهُ مَسْرُوقٌ: إِنَّ اللَّهَ قَسَمَ بَيْنَكُمْ فَأَحْسَنَ الْقَسْمَ، وَإِنَّهُ مَنْ يَرْغَبْ بِرَأْيِهِ عَنْ رَأْيِ اللَّهِ يَضِلَّ، أَوْصِ لِذِي قَرَابَتِكَ مِمَّنْ لَا يَرِثُكَ، ثُمَّ دَعِ الْمَالَ عَلَى مَا قَسَمَهُ اللَّهُ عَلَيْهِ "
Masruq (may Allah have mercy on him) said: "A man was making a will and began to bequeath things that were not appropriate, so indeed Allah has made the best division among you, and whoever leaves Allah's division and follows his own opinion goes astray. You should make a will for those who are not your heirs, then leave the wealth according to Allah's division."
