بَابٌ: هَلْ يُوصِي الرَّجُلُ مِنْ مَالِهِ بِأَكْثَرَ مِنَ الثُّلُثِChapter: Can a man bequeath more than a third of his wealth?
Hadith 1536

سَعِيدٌ قَالَ: أنا أَبُو عَتَّابٍ مُسْلِمُ بْنُ عَطَاءٍ الْقُرَشِيُّ أَنَّ رَجُلًا تُوُفِّيَ فَأَوْصَى فِي قَرَابَتِهِ بِشَيْءٍ فَاسْتَقَلَّتْهُ الْقَرَابَةُ فَقَالُوا لِي: لَوْ زِدْتَهُمْ، وَكُنْتُ أَنَا الْوَصِيَّ، فَقُلْتُ: لَا أَسْتَطِيعُ أَنْ أَزِيدَهُمْ عَلَى مَا أَمَرَ لَهُمْ، فَقَالُوا: فَهَلْ لَكَ أَنْ تَسْأَلَ الْحَسَنَ قُلْتُ: نَعَمْ، فَذَهَبْتُ مَعَ حُمَيْدٍ الطَّوِيلِ إِلَى الْحَسَنِ فَسَأَلَهُ حُمَيْدٌ عَنْ ذَلِكَ وَأَنَا أَسْمَعُ، فَقَالَ: «أُرَاهُ قَدْ سَمَّى لَهُمْ شَيْئًا انْتَهُوا إِلَى مَا سَمَّى لَهُمْ»
Muslim bin Ata (may Allah have mercy on him) narrates that a man made a bequest for his relatives, but the relatives considered it little, so they said: "Increase their share." I said: "I cannot increase their share." Then they said: "Ask Hasan Basri (may Allah have mercy on him)." When he was asked, he said: "What he has specified is sufficient."
