بَابٌ: هَلْ يُوصِي الرَّجُلُ مِنْ مَالِهِ بِأَكْثَرَ مِنَ الثُّلُثِChapter: Can a man bequeath more than a third of his wealth?
Hadith 1529

سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ قَالَ: «إِذَا أَوْصَى الرَّجُلُ بِالثُّلُثِ أَوِ الرُّبُعِ كَانَ فِي الْعَيْنِ وَالدَّيْنِ، وَإِذَا أَوْصَى بِثَلَاثِينَ دِرْهَمًا أَوْ أَرْبَعِينَ دِرْهَمًا، كَانَ مِنَ الْعَيْنِ دُونَ الدَّيْنِ»
Ibrahim (may Allah have mercy on him) said: "When a person makes a bequest of a third or a quarter, it will include both cash and debt, and when the bequest is of specific dirhams or an item, it will be given from the cash."
