بَابٌ: هَلْ يُوصِي الرَّجُلُ مِنْ مَالِهِ بِأَكْثَرَ مِنَ الثُّلُثِChapter: Can a man bequeath more than a third of his wealth?
Hadith 1528

سَعِيدٌ قَالَ: نا أَبُو الْأَحْوَصِ، قَالَ: نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ قَالَ «إِذَا أَوْصَى الرَّجُلُ مِنْ مَالِهِ بِثُلُثٍ أَوْ رُبْعٍ أَوْ خُمُسٍ فَهُوَ مِنْ عَاجِلِ مَالِهِ وَآجِلِهِ، وَإِذَا أَوْصَى لِفُلَانٍ بِكَذَا، وَلِفُلَانٍ بِكَذَا، فَهُوَ مِنْ عَاجِلِ مَالِهِ حَتَّى يَبْلُغَ الثُّلُثَ، فَإِذَا بَلَغَ الثُّلُثَ فَهُوَ مِنَ الْعَاجِلِ وَالْآجِلِ»
Ibrahim (may Allah have mercy on him) said: "When a person makes a bequest of a third, a fourth, or a fifth of his wealth, it will be counted from both the present and deferred wealth. And if a specific item is bequeathed for someone, then as long as the third is not completed, it will be taken only from the present wealth; thereafter, it will be counted from both the present and deferred wealth."
