بَابٌ: هَلْ يُوصِي الرَّجُلُ مِنْ مَالِهِ بِأَكْثَرَ مِنَ الثُّلُثِChapter: Can a man bequeath more than a third of his wealth?
Hadith 1527

سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا عَوْفٌ، قَالَ: شَهِدْتُ هِشَامَ بْنَ هُبَيْرَةَ أُتِيَ فِي رَجُلٍ أَوْصَى لِرَجُلٍ بِمِثْلِ نَصِيبِ بَعْضِ وَلَدِهِ , فَقَالَ هِشَامٌ: «إِنْ كَانَ وَلَدُهُ ذَكَرًا فَلَهُ نَصِيبُ ذَكَرٍ، وَإِنْ كَانُوا إِنَاثًا فَلَهُ نَصِيبُ الْأُنْثَى»
Hisham bin Hubairah (may Allah have mercy on him) said: "If someone makes a bequest for someone equal to one of his sons, then if his sons are male, he will receive the share of a male, and if they are female, he will receive the share of a female."
