بَابٌ: هَلْ يُوصِي الرَّجُلُ مِنْ مَالِهِ بِأَكْثَرَ مِنَ الثُّلُثِChapter: Can a man bequeath more than a third of his wealth?
Hadith 1513

سَعِيدٌ قَالَ: نا مُعْتَمِرُ بْنُ سُلَيْمَانَ، قَالَ: سَمِعْتُ إِسْحَاقَ بْنَ سُوَيْدٍ يُحَدِّثُ عَنِ الْعَلَاءِ بْنِ زِيَادٍ، قَالَ: " أَمَرَنِي وَالِدِي أَنْ أَسْأَلَ عُلَمَاءَ أَهْلِ الْبَصْرَةِ: أَيُّ الْوَصِيَّةِ أَمْثَلُ؟ فَمَا تَتَابَعُوا عَلَيْهِ فَهُوَ وَصِيَّتِي، فَسَأَلْتُهُمْ فَتَتَابَعُوا عَلَى الْخُمُسِ "
It is narrated from Alaa bin Ziyad (may Allah have mercy on him) that his father instructed him to ask the scholars of Basra what the best bequest is. All of them agreed upon the bequest of one-fifth.
