Hadith 1491

سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ مُطَرِّفٍ، عَنْ عَامِرٍ الشَّعْبِيِّ " فِي ثَلَاثَةٍ وَرِثُوا ثَلَاثَمِائَةِ دِرْهَمٍ، فَأَقَرَّ أَحَدُهُمْ بِمِائَةٍ دَيْنٍ قَالَ: يُعْطِي ثُلُثَ الْمِائَةِ ثُمَّ قَالَ: هَذَا خَطَأٌ لَيْسَ يُورَثُ مِيرَاثٌ حَتَّى يُقْضَى الدَّيْنُ، فَأَمَرَهُ أَنْ يُعْطِيَ الْمِائَةَ "
It is narrated from 'Amir al-Sha'bi (may Allah have mercy on him) that three individuals inherited three hundred dirhams. One of them admitted to owing a debt of one hundred dirhams, so it was ordered that he should give one third. Then it was said: "This is incorrect; inheritance is to be distributed only after debts have been paid, therefore the entire debt should be paid."
