بَابُ الرَّجُلِ يُعْتِقُ فَيَمُوتُ وَيَتْرُكُ وَرَثَةً ثُمَّ يَمُوتُ الْمُعْتَقُChapter on a man who frees a slave, then dies and leaves heirs, then the freed slave dies
Hadith 1447

سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا عُبَيْدَةُ، قَالَ: سَأَلْتُ إِبْرَاهِيمَ عَنْ رَجُلٍ مَاتَ وَلَهُ مَوْلًى وَتَرَكَ ثَلَاثَةَ بَنِينَ لَهُ، فَمَاتَ أَحَدُ بَنِيهِ وَتَرَكَ وَلَدًا وَمَاتَ الْمَوْلَى، فَقَالَ: " مِيرَاثُهُ لِابْنَيْهِ، وَلَيْسَ لِابْنِ ابْنِهِ شَيْءٌ، قُلْتُ: فَمَاتَ أَحَدُ الِابْنَيْنِ وَتَرَكَ وَلَدًا ذَكَرًا قَالَ: الْمَالُ لِلْبَاقِي الْآخَرِ، قُلْتُ: فَمَاتَ الْآخَرُ وَلَهُمْ جَمِيعًا أَوْلَادٌ بَعْضُهُمْ أَكْبَرُ مِنْ بَعْضٍ قَالَ: الْوَلَاءُ بَيْنَهُمْ جَمِيعًا "
It is narrated from Ibrahim (may Allah have mercy on him) that a man died and he had a freed slave, and he had three sons. One of them died and left children, then the slave died. He (Ibrahim) said: "The inheritance will be between the two sons, and the grandson will have no share. If one son dies and leaves a son, the wealth will go to the living son. If both die and they have children, some of whom are adults and some minors, then guardianship will be among all of them."
