بَابُ الرَّجُلِ يُعْتِقُ فَيَمُوتُ وَيَتْرُكُ وَرَثَةً ثُمَّ يَمُوتُ الْمُعْتَقُChapter on a man who frees a slave, then dies and leaves heirs, then the freed slave dies
Hadith 1442

سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، فِي أَخَوَيْنِ وَرِثَا مَوْلًى كَانَ أَبُوهُمَا أَعْتَقَهُ، ثُمَّ مَاتَ أَحَدُهُمَا وَتَرَكَ ابْنًا، قَالَ شُرَيْحٌ: «مَنْ مَلَكَ شَيْئًا حَيَاتَهُ فَهُوَ لِوَرَثَتِهِ بَعْدَ مَوْتِهِ» وَقَالَ عَلِيٌّ وَعَبْدُ اللَّهِ وَزَيْدٌ: «الْوَلَاءُ لِلْكُبْرِ»
It is narrated from Ibrahim (may Allah have mercy on him) that two brothers made a slave their heir whom their father had freed, then one of them died and left a son, so Shurayh (may Allah have mercy on him) said: "Whatever a person acquires in his lifetime, after his death its heirs will be his inheritors." And Sayyiduna Ali, Sayyiduna Abdullah, and Sayyiduna Zaid (may Allah be pleased with them) said: "The right of guardianship belongs to the elder."
