بَابُ الرَّجُلِ إِذَا لَمْ يَكُنْ لَهُ وَارِثٌ يَضَعُ مَالَهُ حَيْثُ شَاءَChapter on a man who has no heir and may dispose of his wealth as he wishes
Hadith 1396

سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ وَهِشَامٌ وَابْنُ عَوْنٍ وَمَنْصُورٌ عَنِ ابْنِ سِيرِينَ، قَالَ: قُلْتُ لِعَبِيدَةَ: " رَجُلٌ لَيْسَ لَهُ عَصَبَةٌ تُعْرَفُ، وَلَا لِأَحَدٍ عَلَيْهِ عَقْدٌ أَيُوصِي بِمَالِهِ كُلِّهِ؟ قَالَ: «نَعَمْ إِنْ شَاءَ»
Ibn Sirin (may Allah have mercy on him) said: I asked ‘Ubaidah (may Allah have mercy on him), “If a person has no ‘asaba (male agnate heirs) and no covenant with anyone, can he bequeath all his wealth?” He replied: “Yes, if he wishes.”
