بَابُ مَنْ أَسْلَمَ عَلَى الْمِيرَاثِ قَبْلَ أَنْ يُقْسَمَChapter on one who accepts Islam before the inheritance is distributed
Hadith 1386

سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، قَالَ: سَأَلْتُ إِسْحَاقَ بْنَ عَبْدِ اللَّهِ بْنِ أَبِي فَرْوَةَ عَنِ الرَّجُلِ يُسْلِمُ عَلَى يَدَيِ الرَّجُلِ، فَقَالَ: أَخْبَرَنِي عَمْرُو بْنُ شُعَيْبٍ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، كَتَبَ إِلَى عَمْرِو بْنِ الْعَاصِ: " إِنَّكَ كَتَبْتَ تَسْأَلُنِي عَنْ قَوْمٍ دَخَلُوا فِي الْإِسْلَامِ فِي خفه الْإِسْلَامِ فَمَاتُوا قَالَ: تُرْفَعُ أَمْوَالُ أُولَئِكَ إِلَى بَيْتِ مَالِ الْمُسْلِمِينَ. وَكَتَبْتَ تَسْأَلُنِي عَنِ الرَّجُلِ يُسْلِمُ فَيُعَادُّ الْقَوْمَ وَيُعَاقِلُهُمْ، وَلَيْسَ لَهُ فِيهِمْ قَرَابَةٌ وَلَا لَهُمْ عَلَيْهِ نِعْمَةٌ، فَاجْعَلْ مِيرَاثَهُ لِمَنْ عَاقَلَ وَعَادَّ "
Ismail bin Ayash says: I asked Ishaq bin Abdullah, and he said: Sayyiduna Umar bin Khattab (may Allah be pleased with him) wrote to Amr bin al-As (may Allah be pleased with him) that: "Those who accepted Islam secretly and died, their wealth will go to the Bayt al-Mal (public treasury), and whoever joins a people and sheds blood with them, and has no relation or favor with them, then give his inheritance to them."
