بَابُ مَنْ أَسْلَمَ عَلَى الْمِيرَاثِ قَبْلَ أَنْ يُقْسَمَChapter on one who accepts Islam before the inheritance is distributed
Hadith 1360

سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ أَدْهَمَ السَّدُوسِيِّ، عَنْ رِجَالٍ مِنْ قَوْمِهِ أَنَّ امْرَأَةً مِنْهُمْ نَصْرَانِيَّةً وَلَهَا ابْنَةٌ حَنِيفِيَّةٌ، فَمَاتَتِ الِابْنَةُ وَأَسْلَمَتِ الْأُمُّ قَبْلَ أَنْ يُقْسَمَ الْمِيرَاثُ، فَأَتَوْا بَعْضَ قُضَاةِ الْبَصْرَةِ فَوَرَّثُوهَا، ثُمَّ أَتَوَا الْكُوفَةَ، فَأَتَوْا عَلِيًّا فَذَكَرُوا ذَلِكَ لَهُ، فَقَالَ: مَا كَانَتِ الْأُمُّ حِينَ خَرَجَتِ الرُّوحُ مِنَ الِابْنَةِ؟ قَالُوا: نَصْرَانِيَّةً. فَقَالَ: قَدْ وَجَبَ الْمِيرَاثُ لِأَهْلِهِ، وَلَكِنْ لَهَا حَقٌّ، كَمِ الْمَالُ؟ فَقَالُوا: كَذَا وَكَذَا شَيْئًا لَمْ يَحْفَظْهُ أَدْهَمُ، فَأَعْطَاهَا سِتَّمِائَةٍ "
Some people of the community said: A Christian woman died, her daughter was Muslim, the mother accepted Islam after the daughter's death, the judge of Basra made her an heir, then they came to Sayyiduna Ali (may Allah be pleased with him), he asked: "What was the mother's religion at the time of the daughter's death?" They said: "Christian." He said: "The inheritance has already gone to the original heir, but the mother has a right." Then he gave her six hundred.
