Hadith 1355

سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا إِسْمَاعِيلُ بْنُ سَالِمٍ، قَالَ: سَمِعْتُ الْقَاسِمَ بْنَ عَبْدِ الرَّحْمَنِ بْنِ عَبْدِ اللَّهِ، وَاخْتُصِمَ، إِلَيْهِ فِي امْرَأَةٍ مَاتَتْ وَتَرَكَتْ زَوْجَهَا وَابْنَتَهَا وَعَصَبَتَهَا، فَقَالَ الْقَاسِمُ: «لِلزَّوْجِ الرُّبُعُ، وَمَا بَقِيَ فَلِلِابْنَةِ. وَلَمْ يَجْعَلْ لِلْعَصَبَةِ شَيْئًا. فَأَتَوْا عَبْدَ الْحَمِيدِ بْنَ عَبْدِ الرَّحْمَنِ بْنِ زَيْدِ بْنِ الْخَطَّابِ، وَهُوَ أَمِيرُ الْكُوفَةِ يَوْمَئِذٍ، فَجَعَلَ لِلزَّوْجِ الرُّبُعَ، وَلِلِابِنَةِ النِّصْفَ، وَالرُّبُعَ الْبَاقِيَ لِلْعَصَبَةِ»
A case involving a woman, her husband, her daughter, and an agnate was brought before Qasim bin Abdur Rahman (may Allah have mercy on him). Qasim said: "The husband gets one-fourth, the rest goes to the daughter, and the agnate gets nothing." Then Abdul Hamid bin Abdur Rahman gave the daughter one-half, the husband one-fourth, and the agnate one-fourth.
