Hadith 1339

سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ سُلَيْمَانَ الشَّيْبَانِيِّ، قَالَ: قُلْتُ لِعَامِرٍ الشَّعْبِيِّ: الْعَمَّةُ أَحَقُّ بِالْمِيرَاثِ أَوِ ابْنَةُ الْأَخِ؟ قَالَ: وَأَنْتَ لَا تَعْلَمُ؟ ابْنَةُ الْأَخِ، أَشْهَدُ عَلَى مَسْرُوقٍ أَنَّهُ قَالَ: «أَنْزِلُوهُنَّ مَنَازِلَ آبَائِهِنَّ»
Shu'bi (may Allah have mercy on him) said: I asked 'Amir Shu'bi (may Allah have mercy on him), "Is the paternal aunt given precedence or the niece?" He replied: "Do you not know? The niece is given precedence." I bear witness that Masruq (may Allah have mercy on him) said: "Place them in the position of their father."
