Hadith 1338

سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، قَالَ: أنا الشَّيْبَانِيُّ، عَنِ الشَّعْبِيِّ، قَالَ: سَأَلْتُهُ عَنِ ابْنَةِ الْأَخِ، أَوْلَى أَوِ الْعَمَّةُ، فَقَالَ: ابْنَةُ الْأَخِ، أَشْهَدُ عَلَى مَسْرُوقٍ أَنَّهُ قَالَ: «أَنْزِلُوهُنَّ مَنَازِلَ آبَائِهِنَّ»
Shu'bi (may Allah have mercy on him) said: I asked him, "Is the paternal uncle's daughter given precedence or the paternal aunt?" He said: "The paternal uncle's daughter." I bear witness that Masruq (may Allah have mercy on him) said: "Place them in the position of their father."
