بَابُ الْعَمَّةِ وَالْخَالَةِChapter on paternal and maternal aunts
Hadith 1331

سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا دَاوُدُ بْنُ أَبِي هِنْدَ، عَنِ الشَّعْبِيِّ، قَالَ: انْتَهَى إِلَى زِيَادٍ عَمَّةٌ وَخَالَةٌ، فَقَالَ زِيَادٌ: «أَنَا أَعْلَمُ النَّاسِ بِقَضَاءِ عُمَرَ بْنِ الْخَطَّابِ فِيهَا، جَعَلَ الْعَمَّةَ بِمَنْزِلَةِ الْأَبِ فَجَعَلَ لَهَا الثُّلُثَيْنِ، وَجَعَلَ الْخَالَةَ بِمَنْزِلَةِ الْأُمِّ فَجَعَلَ لَهَا الثُّلُثَ»
It is narrated from ‘Amir Sha‘bi (may Allah have mercy on him) that a case concerning a paternal aunt and a maternal aunt was brought before Ziyad. Ziyad said: “I am most knowledgeable of the ruling of Sayyiduna ‘Umar ibn al-Khattab (may Allah be pleased with him); he gave the paternal aunt the status of the father and allotted her two-thirds, and he gave the maternal aunt the status of the mother and allotted her one-third.”
