سَعِيدٌ قَالَ: نا عَبْدُ الرَّحْمَنِ بْنُ زِيَادٍ، عَنْ شُعْبَةَ، عَنْ أَبِي قَيْسٍ، عَنْ هُزَيْلِ بْنِ شُرَحْبِيلَ، أَنَّ فَرِيضَةً كَانَتْ فِيهِمُ امْرَأَةٌ تَرَكَتْ زَوْجَهَا وَأُمَّهَا وَإِخْوَتَهَا لِأُمِّهَا، وَإِخْوَتَهَا لِأَبِيهَا وَأُمِّهَا، فَقَالَ ابْنُ مَسْعُودٍ: " لِلزَّوْجِ النِّصْفُ وَلِلْأُمِّ السُّدُسُ وَلِإِخْوَتِهَا مِنَ الْأُمِّ مَا بَقِيَ، تَكَامَلَتِ السِّهَامُ، قَالَ هُزَيْلٌ: فَذَكَرْنَا ذَلِكَ لِأَبِي مُوسَى الْأَشْعَرِيِّ، فَقَالَ: لَا تَسْأَلُونِي عَنْ شَيْءٍ مَا دَامَ هَذَا الْحَبْرُ فِيكُمْ "
A woman left behind her husband, mother, maternal uncles, and uncles from both her father’s and mother’s side. Sayyiduna Abdullah bin Mas’ud (may Allah be pleased with him) gave the verdict: “Half to the husband, one-third to the mother, and the remainder to the maternal uncles.” When this was mentioned to Sayyiduna Abu Musa al-Ash’ari (may Allah be pleased with him), he said: “As long as this scholar (Ibn Mas’ud) is among you, do not ask me.”
