بَابُ إِبَاحَةِ الصَّيْدِ بِالْكِلَابِ وَالْجَوَارِحِ
Chapter on permissibility of hunting with dogs and birds of prey
Hadith 4797
حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ بْنِ مُبَشِّرٍ ، نَا أَبُو الأَشْعَثِ أَحْمَدُ بْنُ الْمِقْدَامِ ، نَا يَزِيدُ بْنُ زُرَيْعٍ ، نَا حَبِيبٌ الْمُعَلِّمُ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ أَنَّ رَجُلا أَتَى النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يُقَالُ لَهُ : أَبُو ثَعْلَبَةَ ، فَقَالَ : يَا رَسُولَ اللَّهِ ، " إِنَّ لِي كِلابًا مُكَلَّبَةً ، فَأَفْتِنِي فِي صَيْدِهَا ، فَقَالَ : إِنْ كَانَتْ لَكَ كِلابٌ مُكَلَّبَةٌ فَكُلْ مِمَّا أَمْسَكْنَ عَلَيْكَ ذَكِيٌّ وَغَيْرَ ذَكِيٍّ ، قَالَ : وَإِنْ أَكَلَ مِنْهُ ؟ ، قَالَ : وَإِنْ أَكَلَ مِنْهُ ، قَالَ : يَا رَسُولَ اللَّهِ ، أَفْتِنِي فِي قَوْسِي ، قَالَ : كُلْ مَا رَدَّتْ عَلَيْكَ قَوْسُكَ ، قَالَ : ذَكِيٌّ وَغَيْرَ ذَكِيٍّ ؟ ، قَالَ : ذَكِيٌّ وَغَيْرَ ذَكِيٍّ ، قَالَ : وَإِنْ تَغِيبَ عَنِّي ؟ ، قَالَ : وَإِنْ تَغِيبَ عَنْكَ مَا لَمْ تَضِلَّ أَوْ تَجِدْ فِيهِ سَهْمَكَ ، قَالَ : يَا رَسُولَ اللَّهِ ، أَفْتِنِي فِي آنِيَةِ الْمَجُوسِ إِذَا اضْطُرِرْنَا إِلَيْهَا ، قَالَ : اغْسِلْهَا ثُمَّ كُلْ فِيهَا " .
Amr bin Shu'aib narrates from his father, from his grandfather, that a man came to the service of the Prophet Muhammad (peace be upon him), his name was Abu Tha'labah. He said: O Messenger of Allah! I have some trained dogs, tell me about hunting with them! The Prophet Muhammad (peace be upon him) said: "If your dogs are trained, then whatever game they stop for you, eat it, whether you get a chance to slaughter it or not." The man asked: What if the dog itself eats from it? The Prophet Muhammad (peace be upon him) said: "Even if it eats from it (you may still eat it)." The man said: O Messenger of Allah! Tell me about my bow! The Prophet Muhammad (peace be upon him) said: "Whatever your bow (i.e., arrow) stops, eat it." He asked: Whether it is slaughtered or not? The Prophet Muhammad (peace be upon him) said: "Whether it is slaughtered or not." The man asked: What if the game becomes hidden from me? The Prophet Muhammad (peace be upon him) said: "If it becomes hidden from you, then as long as it is not lost, and as long as you do not find any mark on it other than your arrow, (you may eat it)." The man said: O Messenger of Allah! Tell me about the vessels of the Magians, when we are compelled to use them? The Prophet Muhammad (peace be upon him) said: "Wash them, then you may eat from them."
Hadith 4798
حَدَّثَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ الْبَزَّازُ ، وَمُحَمَّدُ بْنُ أَحْمَدَ بْنِ هَارُونَ الْعَسْكَرِيُّ ، وَالْحَسَنُ بْنُ أَحْمَدَ بْنِ الرَّبِيعِ الأَنْمَاطِيُّ ، قَالُوا : أنا الْحَسَنُ بْنُ عَرَفَةَ ، نَا عَبَّادُ بْنُ عَبَّادٍ الْمُهَلَّبِيُّ ، عَنْ عَاصِمٍ الأَحْوَلِ ، عَنِ الشَّعْبِيِّ ، عَنْ عَدِيِّ بْنِ حَاتِمٍ ، أَنَّهُ سَأَلَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " أَرْمِي بِسَهْمِي فَأُصِيبُ فَلا أَقْدِرُ عَلَيْهِ إِلا بَعْدَ يَوْمٍ أَوْ يَوْمَيْنِ ، فَقَالَ : إِذَا قَدَرْتَ عَلَيْهِ وَلَيْسَ فِيهِ أَثَرٌ ، وَلا خَدْشٌ ، إِلا رَمْيَتُكَ فَكُلْ ، وَإِنْ وَجَدْتَ فِيهِ أَثَرَ غَيْرِ رَمْيَتِكَ ، فَلا تَأْكُلْهُ ، أَوْ قَالَ : لا تَطْعَمْهُ ، فَإِنَّكَ لا تَدْرِي أَنْتَ فَعَلْتَهُ أَوْ غَيْرُكَ ، وَإِذَا أَرْسَلْتَ كَلْبَكَ فَأَخَذَ فَأَدْرَكْتَهُ فَذَكِّهِ ، وَإِنْ وَجَدْتَهُ قَدْ أَخَذَ وَلَمْ يَأْكُلْ شَيْئًا مِنْهُ فَكُلْهُ ، وَإِنْ وَجَدْتَهُ قَدْ قَتَلَهُ فَأَكَلَ مِنْهُ ، فَلا تَأْكُلْ مِنْهُ شَيْئًا ، أَوْ قَالَ : لا تَأْكُلْهُ ، فَإِنَّمَا أَمْسَكَ عَلَى نَفْسِهِ ، قَالَ عَدِيُّ : فَإِنِّي أُرْسِلُ كِلابِي وَأَذْكُرُ اسْمَ اللَّهِ فَتَخْتَلِطُ بِكِلابِ غَيْرِي فَيَأْخُذْنَ الصَّيْدَ فَيَقْتُلْنَهُ ، قَالَ : لا تَأْكُلْهُ ، فَإِنَّكَ لا تَدْرِي أَكِلابُكَ قَتَلَتْهُ ، أَوْ كِلابُ غَيْرِكَ " .
Shu’bi narrates that Sayyiduna ‘Adi bin Hatim (may Allah be pleased with him) asked the Prophet Muhammad (peace and blessings be upon him): I shoot my arrow and hunt an animal, but I reach the prey after one or two days. The Prophet (peace and blessings be upon him) said: “When you gain control over the prey and there is no mark or scratch on it except from your arrow, then eat it. But if you find any other wound or mark besides your arrow, then do not eat it (the narrator is doubtful about one word here). The reason is that you do not know whether you hunted it or someone else hunted it. Similarly, when you release your dog and it catches the prey and you reach the prey, then slaughter it. If you find it in such a state that the dog caught the prey but did not eat anything from it, then eat it. But if you find it in such a state that the dog killed it and also ate something from it, then do not eat the prey (the narrator is doubtful about one word here). The reason is that the animal has kept the prey for itself.” Sayyiduna ‘Adi (may Allah be pleased with him) said: I take the name of Allah when releasing my dog, but another dog joins my dog, and they all hunt and kill the prey. The Prophet (peace and blessings be upon him) said: “Do not eat it! Because you do not know whether your dog killed it or the other dog killed it?”
Hadith 4799
حَدَّثَنَا مُحَمَّدُ بْنُ مَخْلَدٍ ، وَيَعْقُوبُ بْنُ إِبْرَاهِيمَ الْبَزَّازُ ، قَالا : نَا الْحَسَنُ بْنُ عَرَفَةَ ، نَا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ ، عَنْ عَاصِمٍ الأَحْوَلِ ، عَنِ الشَّعْبِيِّ ، عَنْ عَدِيِّ بْنِ حَاتِمٍ رَضِيَ اللَّهُ عَنْهُ ، قَالَ : سَأَلْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " عَنِ الصَّيْدِ ، قَالَ : إِذَا رَمَيْتَ بِسَهْمِكَ فَاذْكُرِ اسْمَ اللَّهِ ، فَإِنْ وَجَدْتَهُ قَدْ قُتِلَ فَكُلْهُ إِلا أَنْ تَجِدَهُ قَدْ وَقَعَ فِي مَاءٍ فَمَاتَ ، فَإِنَّكَ لا تَدْرِي الْمَاءُ قَتَلَهُ أَمْ سَهْمُكَ " .
Sayyiduna ‘Adi bin Hatim (may Allah be pleased with him) narrates that the Prophet Muhammad (peace and blessings be upon him) was asked about hunting. He (peace be upon him) said: "When you shoot your arrow, mention the name of Allah over it. If you find the game dead, then eat it. But if it has fallen into water and died, then you do not know whether it died because of your arrow or because of the water."
Hadith 4800
حَدَّثَنَا مُحَمَّدُ بْنُ مَخْلَدٍ ، نَا مُحَمَّدُ بْنُ الْحَسَنِ الْحَرَّانِيُّ ، نَا شَاذَانُ ، نَا شَرِيكٌ ، عَنِ الْحَجَّاجِ ، عَنِ الْقَاسِمِ بْنِ أَبِي بَزَّةَ ، وَأَبِي الزُّبَيْرِ ، عَنْ سُلَيْمَانَ الْيَشْكُرِيُّ ، عَنْ جَابِرٍ ، قَالَ : " نُهِيَ عَنْ ذَبِيحَةِ الْمَجُوسِيِّ ، وَصَيْدِ كَلْبِهِ وَطَائِرِهِ " .
Sayyiduna Jabir (may Allah be pleased with him) narrates: (The Prophet, peace and blessings be upon him,) forbade (eating) the animal slaughtered by a Magian, or the game hunted by his dog, or the game hunted by his bird.
