Hadith 4600
حَدَّثَنَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، نَا يُوسُفُ بْنُ مُوسَى ، نَا عُبَيْدُ اللَّهِ بْنُ مُوسَى ، نَا مُحَمَّدُ بْنُ رَاشِدٍ ، عَنْ سُلَيْمَانَ بْنِ مُوسَى ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " رَدَّ شَهَادَةِ الْخَائِنِ ، وَالْخَائِنَةِ ، وَذِي الْغِمْرِ عَلَى أَخِيهِ ، وَرَدَّ شَهَادَةَ الْقَانِعِ لأَهْلِ الْبَيْتِ ، وَأَجَازَهَا عَلَى غَيْرِهِمْ " .
Amr ibn Shu'ayb narrates from his father, from his grandfather: The Prophet Muhammad (peace be upon him) rejected the testimony of a treacherous man, a treacherous woman, a person who harbors malice against his brother, and a servant in the household; however, they may testify in favor of others besides their own household.
Hadith 4601
حَدَّثَنَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، نَا عِيسَى بْنُ أَبِي حَرْبٍ ، نَا يَحْيَى بْنُ أَبِي بُكَيْرٍ ، نَا أَبُو جَعْفَرٍ الرَّازِيُّ ، عَنْ آدَمَ بْنِ فَائِدٍ ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لا تَجُوزُ شَهَادَةُ خَائِنٍ ، وَلا خَائِنَةٍ ، وَلا مَحْدُودٍ فِي الإِسْلامِ ، وَلا مَحْدُودَةٍ ، وَلا ذِي غِمْرٍ عَلَى أَخِيهِ " .
Amr bin Shu'aib, from his father, from his grandfather, reports that the Prophet Muhammad (peace be upon him) said: "The testimony of a treacherous man, a treacherous woman, a man punished with hadd, a woman punished with hadd, and one who harbors malice against his brother will not be accepted."
Hadith 4602
نَا أَحْمَدُ بْنُ عَبْدِ اللَّهِ بْنِ مُحَمَّدِ الْوَكِيلُ ، نَا أَبُو بَدْرٍ ، وَعَبَّادُ بْنُ الْوَلِيدِ ، قَالا : نَا حَبَّانُ بْنُ هِلالٍ ، نَا عَبْدُ الْوَاحِدِ بْنُ زِيَادٍ ، حَدَّثَنِي يَزِيدُ بْنُ أَبِي زِيَادٍ الْقُرَشِيُّ ، نَا الزُّهْرِيُّ ، عَنْ عُرْوَةَ ، عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا تَرْفَعُهُ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لا تَجُوزُ شَهَادَةُ خَائِنٍ ، وَلا خَائِنَةٍ ، وَلا مَجْلُودٍ حَدًّا ، وَلا ذِي غِمْرٍ عَلَى أَخِيهِ ، وَلا الْقَانِعِ مِنْ أَهْلِ الْبَيْتِ لَهُمْ " ، يَزِيدُ هَذَا ، ضَعِيفٌ لا يُحْتَجُّ بِهِ.
Lady Aisha (may Allah be pleased with her) narrates that the Noble Prophet (peace and blessings be upon him) said: "The testimony of a treacherous man, a treacherous woman, a man punished for a hadd crime, a person who harbors malice against his brother, and a household servant against the family members is not valid."
Hadith 4603
حَدَّثَنَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْفَارِسِيُّ ، نَا الْحَسَنُ بْنُ عَلِيِّ بْنِ خَلَفٍ الدِّمَشْقِيُّ ، نَا سُلَيْمَانُ بْنُ عَبْدِ الرَّحْمَنِ ، نَا عَبْدُ الأَعْلَى بْنُ مُحَمَّدٍ ، نَا يَحْيَى بْنُ سَعِيدٍ ، نَا الزُّهْرِيُّ ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ ، أَنّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَطَبَ ، فَقَالَ : " أَلا لا تَجُوزُ شَهَادَةُ الْخَائِنِ وَلا الْخَائِنَةِ ، وَلا ذِي غِمْرٍ عَلَى أَخِيهِ ، وَلا الْمَوْقُوفِ عَلَى حَدٍّ " ، يَحْيَى بْنُ سَعِيدٍ مَتْرُوكٌ ، وَعَبْدُ الأَعْلَى ، ضَعِيفٌ.
Abdullah bin Umar (may Allah be pleased with them both) narrates that the Prophet Muhammad (peace be upon him) said while delivering a sermon: "Be aware that the testimony of a treacherous man, a treacherous woman, a person who harbors malice against his brother, and a person upon whom a legal punishment has been carried out, is not valid."
Hadith 4604
حَدَّثَنَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، نَا يُوسُفُ بْنُ مُوسَى ، نَا يَحْيَى بْنُ الضُّرَيْسِ ، أَخْبَرَنِي الْمُثَنَّى ، عَنْ عَمْرِو بْنِ شُعَيْبٍ ، عَنْ أَبِيهِ ، عَنْ جَدِّهِ أَنّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " لا تَجُوزُ شَهَادَةُ خَائِنٍ ، وَلا خَائِنَةٍ ، وَلا مَوْقُوفٍ عَلَى حَدٍّ ، وَلا ذِي غِمْرٍ عَلَى أَخِيهِ " .
Amr ibn Shu'aib narrates from his father, from his grandfather, that the Prophet Muhammad (peace be upon him) said: "The testimony of a treacherous man, a treacherous woman, a person upon whom a legal punishment has been carried out, and a person who bears malice against his brother and testifies against him, their testimony is not valid."
Hadith 4605
حَدَّثَنَا عَلِيُّ بْنُ مُبَشِّرٍ ، نَا مُحَمَّدُ بْنُ عُبَادَةَ ، نَا أَبُو أُسَامَةَ ، عَنْ عَبْدِ الْوَاحِدِ ، قَالَ : سَمِعْتُ مُجَالِدًا ، يَذْكُرُ عَنِ الشَّعْبِيِّ ، قَالَ : كَانَ شُرَيْحٌ ، " يُجِيزُ شَهَادَةَ كُلِّ مِلَّةٍ عَلَى مِلَّتِهَا ، وَلا يُجِيزُ شَهَادَةَ الْيَهُودِيِّ عَلَى النَّصْرَانِيِّ ، وَلا النَّصْرَانِيِّ عَلَى الْيَهُودِيِّ ، إِلا الْمُسْلِمِينَ فَإِنَّهُ كَانَ يُجِيزُ شَهَادَتَهُمْ عَلَى الْمِلَلِ كُلِّهَا " .
Shu'bi narrates that Qadi Shurayh used to accept the testimony of a person belonging to a certain religion against another person of the same religion; he would not accept the testimony of a Jew against a Christian, nor a Christian against a Jew. However, the matter was different regarding Muslims, for he would accept the testimony of any Muslim against all other religions.
Hadith 4606
حَدَّثَنَا أَبُو بَكْرٍ الشَّافِعِيُّ ، نَا أَبُو قَبِيصَةَ مُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ بْنِ عُمَارَةَ بْنِ الْقَعْقَاعِ ، نَا دَاوُدُ بْنُ عَمْرٍو ، نَا صَالِحُ بْنُ مُوسَى ، عَنْ عَبْدِ الْعَزِيزِ بْنِ رُفَيْعٍ ، عَنْ أَبِي صَالِحٍ ، عَنْ أَبِي هُرَيْرَةَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " شَيْئَيْنِ لَنْ تَضِلُّوا بَعْدَهُمَا : كِتَابُ اللَّهِ وَسُنَّتِي ، وَلَنْ يَفْتَرِقَا حَتَّى يَرِدَا عَلَيَّ الْحَوْضَ " .
Abu Huraira (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: "I am leaving two things among you; after (holding onto) them, you will not go astray: the Book of Allah and my Sunnah. These two will not be separated until they reach me at the Pond."
Hadith 4607
نَا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْفَارِسِيُّ ، نَا الْوَلِيدُ بْنُ مَرْوَانَ ، نَا جُنَادَةُ بْنُ مَرْوَانَ ، نَا أَبِي ، نَا شَعْوَذُ بْنُ عَبْدِ الرَّحْمَنِ ، عَنْ خَالِدِ بْنِ مَعْدَانَ ، قَالَ : قَالَ كَعْبُ بْنُ عَاصِمٍ الأَشْعَرِيُّ : إِنِّي سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : " إِنَّ اللَّهَ تَعَالَى أَجَارَنِي عَلَى أُمَّتِي مِنْ ثَلاثٍ : لا يَجُوعُوا ، وَلا يَسْتَجْمِعُوا عَلَى ضَلالٍ ، وَلا تُسْتَبَاحُ بَيْضَةُ الْمُسْلِمِينَ " .
Sayyiduna Ka'b bin Asim Ash'ari (may Allah be pleased with him) narrates that I heard the Noble Prophet (peace and blessings be upon him) say: "Allah Almighty has granted me protection regarding three things for my Ummah: they will not remain hungry, they will not agree upon misguidance, and they will not be completely annihilated."
Hadith 4608
حَدَّثَنَا أَبِي ، نَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ نَاجِيَةَ ، نَا مُحَمَّدُ بْنُ يَحْيَى بْنِ أَبِي سَمِينَةَ ، نَا مُحَمَّدُ بْنُ يَحْيَى بْنِ قَيْسٍ الْمَأْرَبِيُّ ، عَنْ ثُمَامَةَ بْنِ شَرَاحِيلَ ، عَنْ سُمَيِّ بْنِ قَيْسٍ ، عَنْ شُمَيْرٍ ، عَنْ أَبْيَضَ بْنِ حَمَّالٍ ، قَالَ : قُلْتُ : يَا رَسُولَ اللَّهِ ، " مَا يَحْمِي مِنَ الأَرَاكِ ؟ ، قَالَ : مَا لا تَنَالُهُ أَخْفَافُ الإِبِلِ " .
Sayyiduna Abyad bin Hamaal (may Allah be pleased with him) narrates that I submitted: O Messenger of Allah! What may I pick from the Pilu tree? So the Noble Prophet (peace and blessings be upon him) said: "That which the camel's feet cannot reach."
Hadith 4609
حَدَّثَنَا حَدَّثَنَا أَبُو عَبْدِ اللَّهِ بْنُ الْمُحْرِمِ ، نَا مُحَمَّدُ بْنُ عُثْمَانَ بْنِ أَبِي شَيْبَةَ ، نَا مُحَمَّدُ بْنُ إِسْحَاقَ السَّمُرِيُّ ، نَا مَرْوَانُ بْنُ جَعْفَرٍ السَّمُرِيُّ ، حَدَّثَنِي أَبِي ، أَنَّ الْمُغِيرَةِ بْنَ شُعْبَةَ ، وَمَصْقَلَةَ بْنَ هُبَيْرَةَ الشَّيْبَانِيَّ ، تَنَازَعَا بِالْكُوفَةِ فَفَخَرَ الْمُغِيرَةُ بِمَكَانِهِ مِنْ مُعَاوِيَةَ عَلَى مَصْقَلَةَ ، فَقَالَ لَهُ مَصْقَلَةُ : وَاللَّهِ لأَنَا أَعْظَمُ عَلَيْهِ حَقًّا مِنْكَ ، قَالَ لَهُ الْمُغِيرَةُ " وَلِمَ ؟ " ، قَالَ لَهُ مَصْقَلَةُ : لأَنِّي فَارَقْتُ عَلِيَّ بْنَ أَبِي طَالِبٍ عَلَيْهِ السَّلامُ فِي الْمُهَاجِرِينَ وَالأَنْصَارِ وَوُجُوهِ أَهْلِ الْعِرَاقِ ، وَلَحِقْتُ بِمُعَاوِيَةَ فَضَرَبْتُ مَعَهُ بِسَيْفِي ، وَاسْتَعْمَلَنِي عَلَى الْبَحْرَيْنِ فَأَعْتَقْتُ لَهُ بَنِي سَامَةَ بْنِ لُؤَيِّ بْنِ غَالِبٍ بَعْدَ مَا مُلِكَتْ رِقَابُهُمْ وَأُبِيحَتْ حُرْمَتُهُمْ ، وَأَنْتَ مُقِيمٌ بِالطَّائِفِ تُنَاغِي نِسَاءَكَ ، وَتُرَشِّحُ أَطْفَالَكَ طَوِيلُ اللِّسَانِ قَصِيرُ الْيَدِ ، تُلْقِي بِالْمَوَدَّةِ مِنْ مَكَانٍ بَعِيدٍ حَتَّى إِذَا اسْتَقَامَتِ الأُمُورُ غَلَبْتَنَا غَلَبَةً ، فَقَالَ لَهُ الْمُغِيرَةُ : " وَاللَّهِ يَا مَصْقَلَةُ مَا زِلْتَ مُنْذُ الْيَوْمِ تُكْثِرُ الْحَزَّ وَتُحْطِي الْمَفَاصِلَ ، أَمَّا تَرْكُكَ عَلِيًّا فَقَدْ فَعَلْتَ فَلَمْ تُؤْنِسْ أَهْلَ الشَّامِ ، وَلَمْ تُوحِشْ أَهْلَ الْعِرَاقِ ، وَأَمَّا قَوْلُكَ فِي عِتْقِ بَنِي سَامَةَ بْنِ لُؤَيٍّ ، فَإِنَّمَا أَعْتَقَهُمْ ثِقَةُ عَلِيٍّ رَضِيَ اللَّهُ عَنْهُ بِكَ ، أَمَا وَاللَّهِ مَا صَبَرْتَ لَهُمْ نَفْسَكَ وَلا أَعْتَقْتَهُمْ مِنْ مَالِكَ ، وَأَمَّا مَقَامِي بِالطَّائِفِ فَقَدْ أَبْلانِي اللَّهُ تَعَالَى فِي الْخَفْضِ مَا لَمْ يُبْلِكَ فِي الظَّعْنِ ، وَلِلَّهِ تَعَالَى عَلَيْنَا ، فَإِنْ أَنْتَ عَادَيْتَنَا فَإِنَّ اللَّهَ عَزَّ وَجَلَّ مِنْ وَرَائِكَ " .
Marwan Ja'far narrates that my father told me that once in Kufa there was a disagreement between Sayyiduna Mughirah bin Shu'bah and Musqalah bin Hubayrah. Mughirah expressed pride before Musqalah regarding his closeness to Sayyiduna Mu'awiyah (may Allah be pleased with him). So Musqalah said to him: By Allah! I have more right that he should be closer to me. Sayyiduna Mughirah (may Allah be pleased with him) asked him: Why is that? Musqalah said to him: The reason is that I left Sayyiduna Ali bin Abi Talib (may Allah be pleased with him) among the Muhajirun, the Ansar, and the great people of Iraq, and I went to Sayyiduna Mu'awiyah (may Allah be pleased with him) and continued to fight with the sword alongside him, and he appointed me as governor, so I freed Banu Samah bin Lu'ayy for him, even though I had become the owner of their necks and their honor had become lawful for me. Whereas you were staying in Ta'if, enjoying yourself with your wives and playing with your children, your tongue was sharp, you were stingy, you did not care about kinship, but when the matter was settled, then you prevailed over us. Sayyiduna Mughirah (may Allah be pleased with him) said to him: By Allah! O Musqalah! Today you are saying these things, as for your leaving Sayyiduna Ali (may Allah be pleased with him), you did so, but you did not do this out of love for the people of Sham, rather you did it out of hatred for the people of Iraq. As for your saying that you freed Banu Samah bin Lu'ayy, then a trustworthy companion of Sayyiduna Ali (may Allah be pleased with him) trusted you and freed them. By Allah! You did not attach yourself to them, nor did you free them from your own wealth. As for my staying in Ta'if, the reason is that Allah Almighty tested me with the trial of home and family, in which He did not test you, which is regarding wives. This is Allah Almighty's favor upon us, if you have shown enmity towards us, then Allah Almighty is watching you.
