Hadith 4457
حَدَّثَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ عَبْدِ اللَّهِ بْنِ مُبَشِّرٍ ، نَا أَحْمَدُ بْنُ سِنَانٍ الْقَطَّانُ ، نَا يَزِيدُ بْنُ هَارُونَ ، عَنْ فَرَجِ بْنِ فَضَالَةَ ، عَنْ مُحَمَّدِ بْنِ عَبْدِ الأَعْلَى بْنِ عَدِيٍّ ، عَنْ أَبِيهِ ، عَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو ، قَالَ : جَاءَ رَجُلانِ يَخْتَصِمَانِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِعَمْرِو بْنِ الْعَاصِ : " اقْضِ بَيْنَهُمَا ، قَالَ : وَأَنْتَ هَا هُنَا يَا رَسُولَ اللَّهِ ؟ قَالَ : نَعَمْ ، قَالَ : عَلَى مَا أَقْضِي ؟ ، قَالَ : إِنِ اجْتَهَدْتَ فَأَصَبْتَ لَكَ عَشَرَةُ أُجُورٍ ، وَإِنِ اجْتَهَدْتَ فَأَخْطَأْتَ فَلَكَ أَجْرٌ وَاحِدٌ " ، .
Sayyiduna Abdullah bin Amr (may Allah be pleased with him) narrates that two men brought their case to the Prophet Muhammad (peace and blessings be upon him). The Prophet (peace and blessings be upon him) said to Sayyiduna Amr bin al-As (may Allah be pleased with him): "You decide between the two of them." He said: "O Messenger of Allah! In your presence?" The Prophet (peace and blessings be upon him) said: "Yes!" He said: "How should I decide?" The Prophet (peace and blessings be upon him) said: "If you exercise ijtihad and make the correct decision, you will have ten rewards, and if you exercise ijtihad and make a mistake, you will have one reward."
Hadith 4458
نَا ابْنُ مُبَشِّرٍ ، نَا أَحْمَدُ بْنُ سِنَانٍ ، نَا يَزِيدُ بْنُ هَارُونَ ، نَا فَرَجُ بْنُ فَضَالَةَ ، عَنْ رَبِيعَةَ بْنِ يَزِيدَ ، عَنْ عُقْبَةَ بْنِ عَامِرٍ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بِمِثْلِهِ ، إِلا أَنَّهُ جَعَلَ مَكَانَ الأُجُورِ حَسَنَاتٍ.
This narration is also transmitted with another chain, however, in it the word "good deed" is used instead of "reward."
Hadith 4459
حَدَّثَنِي أَبُو سَهْلِ بْنُ زِيَادُ أَحْمَدُ بْنُ مُحَمَّدِ بْنِ عَبْدِ اللَّهِ ، نَا بِشْرُ بْنُ مُوسَى ، نَا أَبُو عَبْدِ اللَّهِ مُحَمَّدُ بْنُ الْفَرَجِ بْنِ فَضَالَةَ ، حَدَّثَنِي أَبِي الْفَرَجُ بْنُ فَضَالَةَ ، عَنْ رَبِيعَةَ بْنِ يَزِيدَ الدِّمَشْقِيِّ ، عَنْ عُقْبَةَ بْنِ عَامِرٍ ، قَالَ : جَاءَ خَصْمَانِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَخْتَصِمَانِ ، فَقَالَ لِي : " قُمْ يَا عُقْبَةُ اقْضِ بَيْنَهُمَا ، قُلْتُ : يَا رَسُولَ اللَّهِ ، أَنْتَ أَوْلَى بِذَلِكَ مِنِّي ، قَالَ : وَإِنْ كَانَ اقْضِ بَيْنَهُمَا فَإِنِ اجْتَهَدْتَ فَأَصَبْتَ فَلَكَ عَشَرَةُ أُجُورٍ ، وَإِنِ اجْتَهَدْتَ فَأَخْطَأْتَ فَلَكَ أَجْرٌ وَاحِدٌ " .
Sayyiduna Uqbah bin Amir (may Allah be pleased with him) narrates that two men brought their case to the Prophet Muhammad (peace and blessings be upon him). The Prophet (peace and blessings be upon him) said: "O Uqbah! Stand up and judge between them." I said: "O Messenger of Allah! You are more deserving of this." The Prophet (peace and blessings be upon him) said: "If you judge between them and strive to reach a decision and are correct, you will have ten rewards. And if you strive and make a mistake, you will have one reward."
Hadith 4460
نَا أَبُو عُبَيْدٍ الْقَاسِمُ بْنُ إِسْمَاعِيلَ ، نَا الْقَاسِمُ بْنُ هَاشِمٍ ، نَا عَلِيُّ بْنُ عَيَّاشٍ ، نَا أَبُو مُطِيعٍ مُعَاوِيَةُ بْنُ يَحْيَى عَنِ ابْنِ لَهِيعَةَ ، عَنْ أَبِي الْمُصْعَبِ الْمَعَافِرِيِّ ، عَنْ مُحَرَّرِ بْنِ أَبِي هُرَيْرَةَ ، عَنْ أَبِي هُرَيْرَةَ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " إِذَا قَضَى الْقَاضِي فَاجْتَهَدَ فَأَصَابَ كَانَتْ لَهُ عَشَرَةُ أُجُورٍ ، وَإِذَا قَضَى فَاجْتَهَدَ فَأَخْطَأَ كَانَ لَهُ أَجْرَانِ " .
Sayyiduna Abu Huraira (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: When a person exercises ijtihad while making a judgment and gives a correct decision, he receives ten rewards, and when a person exercises ijtihad while making a judgment and makes a mistake, he receives two rewards.
Hadith 4461
نَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ ، نَا عَبْدُ اللَّهِ بْنُ عُمَرَ الْخَطَّابِيُّ ، نَا الدَّرَاوَرْدِيُّ ، عَنْ عَبْدِ اللَّهِ بْنِ سَعِيدِ بْنِ أَبِي هِنْدَ ، عَنْ عُثْمَانَ بْنِ مُحَمَّدٍ الأَخْنَسِيِّ ، عَنْ سَعِيدِ بْنِ أَبِي سَعِيدٍ الْمَقْبُرِيِّ ، عَنْ أَبِي هُرَيْرَةَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنِ اسْتُعْمِلَ عَلَى الْقَضَاءِ ، فَقَدْ ذُبِحَ بِغَيْرِ سِكِّينٍ " .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: "Whoever desires to become a judge has been slaughtered without a knife."
Hadith 4462
قُرِئَ عَلَى عَبْدِ اللَّهِ بْنِ مُحَمَّدٍ ، وَأَنَا أَسْمَعُ ، حَدَّثَكُمْ أَبُو كَامِلٍ ، نَا فُضَيْلُ بْنُ سُلَيْمَانَ ، نَا عَمْرُو بْنُ أَبِي عَمْرٍو ، عَنْ سَعِيدِ بْنِ أَبِي سَعِيدٍ ، عَنْ أَبِي هُرَيْرَةَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ وُلِّيَ الْقَضَاءَ ، فَقَدْ ذُبِحَ بِغَيْرِ سِكِّينٍ " .
Sayyiduna Abu Huraira (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: "Whoever is appointed as a judge, it is as if he has been slaughtered without a knife."
Hadith 4463
نَا عُمَرُ بْنُ أَحْمَدَ بْنِ عَلِيٍّ الْجَوْهَرِيُّ ، نَا مُحَمَّدُ بْنُ عِمْرَانَ بْنِ حَبِيبٍ ، نَا هِشَامُ بْنُ عُبَيْدِ اللَّهِ ، نَا عَبْدُ اللَّهِ بْنُ جَعْفَرِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْمِسْوَرِ بْنِ مَخْرَمَةَ ، عَنْ عُثْمَانَ بْنِ مُحَمَّدٍ ، عَنِ الأَعْرَجِ ، وَالْمَقْبُرِيِّ ، عَنْ أَبِي هُرَيْرَةَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنْ جُعِلَ قَاضِيًا ، فَقَدْ ذُبِحَ بِغَيْرِ سِكِّينٍ " .
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: "Whoever is appointed as a judge has been slaughtered without a knife."
Hadith 4464
نَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ ، نَا مُحَمَّدُ بْنُ يَحْيَى ، وَأَحْمَدُ بْنُ يُوسُفَ السُّلَمِيُّ . ح وَنا ابْنُ صَاعِدٍ ، وَإِسْمَاعِيلُ الْوَرَّاقُ ، قَالا : نَا مُحَمَّدُ بْنُ عَبْدِ الْمَلِكِ بْنِ زَنْجُوَيْهِ ، قَالُوا : نَا عَبْدُ الرَّزَّاقِ ، نَا مَعْمَرٌ ، عَنْ سُفْيَانَ الثَّوْرِيِّ ، عَنْ يَحْيَى بْنِ سَعِيدٍ ، عَنْ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ ، عَنْ أَبِي سَلَمَةَ ، عَنْ أَبِي هُرَيْرَةَ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " إِذَا حَكَمَ الْحَاكِمُ فَاجْتَهَدَ فَأَصَابَ كَانَ لَهُ أَجْرَانِ ، وَإِذَا اجْتَهَدَ فَأَخْطَأَ كَانَ لَهُ أَجْرٌ " ، هَذَا لَفْظُ النَّيْسَابُورِيِّ ، وَقَالَ ابْنُ صَاعِدٍ : " وَإِذَا قَضَى الْقَاضِي فَاجْتَهَدَ فَأَصَابَ فَلَهُ أَجْرَانِ ، وَإِذَا قَضَى فَأَخْطَأَ فَلَهُ أَجْرٌ ".
Sayyiduna Abu Hurairah (may Allah be pleased with him) narrates that the Noble Prophet (peace and blessings be upon him) said: "When a person who makes judgments exercises ijtihad (independent reasoning) and gives a correct judgment, he receives two rewards, and when he exercises ijtihad and makes a mistake in his judgment, he receives one reward." In another narration, the words are: "When a judge exercises ijtihad while making a judgment and gives a correct judgment, he receives two rewards, and when he makes a mistake while making a judgment, he receives one reward."
Hadith 4465
وَنا أَبُو حَامِدٍ مُحَمَّدُ بْنُ هَارُونَ الْحَضْرَمِيُّ ، نَا عَمْرُو بْنُ عَلِيٍّ ، نَا يَحْيَى بْنُ سَعِيدٍ ، نَا مُجَالِدُ بْنُ سَعِيدٍ ، نَا عَامِرٌ ، عَنْ مَسْرُوقٍ ، عَنْ عَبْدِ اللَّهِ ، عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، قَالَ : " مَا مِنْ حَاكِمٍ يَحْكُمُ بَيْنَ النَّاسِ إِلا يُبْعَثُ يَوْمَ الْقِيَامَةِ وَمَلَكٌ آخِذٌ بِقَفَاهُ حَتَّى يُوقِفَهُ عَلَى شَفِيرِ جَهَنَّمَ ، ثُمَّ يَلْتَفِتُ إِلَى اللَّهِ مُغْضَبًا ، فَإِنْ قَالَ : أَلْقِهِ أَلْقَاهُ فِي الْمَهْوَى أَرْبَعِينَ خَرِيفًا " ، وَقَالَ مَسْرُوقٌ : لأَنْ أَقْضِيَ يَوْمًا بِحَقٍّ ، أَحَبُّ إِلَيَّ مِنْ أَنْ أَغْزُوَ سَنَةً فِي سَبِيلِ اللَّهِ عَزَّ وَجَلَّ.
Sayyiduna Abdullah (may Allah be pleased with him) narrates this statement of the Noble Prophet (peace and blessings be upon him): "Whoever is a ruler and judges among the people, when he is resurrected on the Day of Judgment, an angel will seize him by the nape of his neck and stand him at the edge of Hell. Then, when that angel looks towards Allah Almighty in anger at that person, Allah Almighty will say: 'Throw him into it.' So the angel will throw him into Hell, whose depth is the distance of forty years." The narrator named Masruq states: If I judge with justice for one day, it is more beloved to me than striving in the path of Allah for a hundred years.
Hadith 4466
وَنا أَبُو عُبَيْدٍ الْقَاسِمُ بْنُ إِسْمَاعِيلَ الْمَحَامِلِيُّ ، نَا عَبْدُ اللَّهِ بْنُ مُحَمَّدِ بْنِ يَحْيَى بْنِ أَبِي بُكَيْرٍ ، نَا يَحْيَى بْنُ أَبِي بُكَيْرٍ ، نَا زُهَيْرٌ ، عَنْ عَبَّادِ بْنِ كَثِيرٍ ، عَنْ أَبِي عَبْدِ اللَّهِ ، عَنْ عَطَاءِ بْنِ يَسَارٍ ، عَنْ أُمِّ سَلَمَةَ رَضِيَ اللَّهُ عَنْهَا ، قَالَتْ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنِ ابْتُلِيَ بِالْقَضَاءِ بَيْنَ النَّاسِ فَلْيَعْدِلْ بَيْنَهُمْ فِي لَحْظِهِ ، وَإِشَارَتِهِ ، وَمَقْعَدِهِ " .
Lady Umm Salamah (may Allah be pleased with her) narrates that the Noble Prophet (peace and blessings be upon him) said: "Whoever is tested with judging between people, then he should act justly among the people, in his conduct, in his gestures, and in his manner of sitting (in every respect, he should act justly)."
Hadith 4467
وَبِهِ وَبِهِ عَنْ أُمِّ سَلَمَةَ ، قَالَتْ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنِ ابْتُلِيَ بِالْقَضَاءِ بَيْنَ النَّاسِ فَلا يَرْفَعَنَّ صَوْتَهُ عَلَى أَحَدِ الْخَصْمَيْنِ مَا لا يَرْفَعُ عَلَى الآخَرِ " .
Lady Umm Salamah (may Allah be pleased with her) narrates that the Noble Prophet (peace and blessings be upon him) said: "Whoever is put to trial by being made a judge among the people, he should not raise his voice before one of the two parties in a case until he raises his voice before the other party as well (i.e., he should treat both equally)."
Hadith 4468
وَبِإِسْنَادِهِ وَبِإِسْنَادِهِ عَنْ أُمِّ سَلَمَةَ ، قَالَتْ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " مَنِ ابْتُلِيَ بِالْقَضَاءِ بَيْنَ الْمُسْلِمِينَ ، فَلا يَقْضِيَنَّ بَيْنَ اثْنَيْنِ وَهُوَ غَضْبَانُ " .
Lady Umm Salamah (may Allah be pleased with her) narrates that the Noble Prophet (peace and blessings be upon him) said: "Whoever is put to trial with judging between Muslims should not decide between two parties while he is angry."
Hadith 4469
نَا الْحُسَيْنُ بْنُ إِسْمَاعِيلَ ، نَا الْعَبَّاسُ بْنُ يَزِيدَ الْبَحْرَانِيُّ ، نَا إِبْرَاهِيمُ بْنُ صَدَقَةَ ، نَا سُفْيَانُ بْنُ حُسَيْنٍ ، عَنْ أَبِي بِشْرٍ ، عَنِ ابْنِ جَوْشَنٍ ، عَنْ أَبِي بَكْرَةَ ، " أَنَّهُ كَتَبَ إِلَى ابْنِهِ وَهُوَ قَاضِي بِسِجِسْتَانَ ، إِنِّي سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ، يَقُولُ : لا يَقْضِيَنَّ الْقَاضِي بَيْنَ اثْنَيْنِ وَهُوَ غَضْبَانُ ، وَلا يَقْضِيَنَّ فِي أَمْرٍ قَضَائَيْنِ " .
It is narrated about Sayyiduna Abu Bakrah, may Allah be pleased with him, that he wrote in a letter to his son, who was a judge in Sijistan: "I heard the Noble Prophet, peace and blessings be upon him, say: 'No judge should decide between two people while angry, and he should not give two judgments in one matter.'"
Hadith 4470
نَا عَبْدُ اللَّهِ بْنُ أَحْمَدَ بْنِ ثَابِتٍ الْبَزَّازُ ، نَا الْقَاسِمُ بْنُ عَاصِمٍ ، نَا مُوسَى بْنُ دَاوُدَ ، نَا الْقَاسِمُ بْنُ عَبْدِ اللَّهِ الْعُمَرِيُّ ، عَنْ عَبْدِ اللَّهِ بْنِ عَبْدِ الرَّحْمَنِ الأَنْصَارِيِّ ، عَنْ أَبِيهِ ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ ، قَالَ : قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ : " لا يَقْضِي الْقَاضِي إِلا وَهُوَ شَبْعَانُ رَيَّانُ " .
Abu Sa'id al-Khudri (may Allah be pleased with him) narrates that the Prophet Muhammad (peace be upon him) said: "A judge should give a verdict when he is satiated and has eaten and drunk (i.e., he should not give a verdict in a state of restlessness, anxiety, or mental disturbance)."
